BSN (Supplement company) sued for intentionally misleading clientele

I have heard about it for a long time but now we have the official lawsuit.  My wife and I always suspected the supplement giant's claims were a little too good to be true.  It turns out that we were right.  BSN was sued recently for claiming that their highly popular product "CELLMASS" has a truly revolutionary ingredient in it called Creatine ethyl ester malate (otherwise referred to as CEM3).  It was claimed on their label, website and marketing collateral.  It was also claimed that BSN posses a patent pending for this ingredient.

It turns out that the compound has never been made.  Since it has never been created or obviously manufactured it makes it rather difficult to have the ingredient comprise 18% of each of their CELLMASS units.  It is also claimed by BSN that this non existent ingredient is in their N.O.-XPLODE & NITRIX products.

The lack of integrity that this displays is dumbfounding.  Duping the general public that trusts what is on labels is legitimate is unconscionable.  There are no regulators in the supplement industry and this here is one of the serious repercussions of not having "big brother" look over ones shoulder.  It is said that one bad apple can ruin a bunch, but in this case I think this intentional misleading and fraudulent behavior is the rule not the exception.
